How does the LMIA process work?

Canadian employers can hire temporary foreign workers (TFW) to work in their organizations. They must submit a Labor Market Impact Assessment (LMIA *formerly called LMO) application to Employment and Social Development Canada (ESDC)/Service Canada.

If the employer receives a positive LMIA, then the TFW can apply to Immigration, Refugees, and Citizenship Canada (IRCC) for their work permit.

How do I get an LMIA?

An employer in Canada can offer a job to a Temporary Foreign Worker (TWF) when there is no suitable Canadian citizen or permanent resident for the position. He then has to start the LMIA process. The requirements to obtain a positive LMIA are rigorous, and the employer must be prepared to comply with all conditions imposed by ESDC/Service Canada.

The prospective employer should have answers to questions about the recruitment process and should verify that the job offer is a genuine one. They should also specify if they have submitted an LMIA in the past. TFWs on their part should be shown IRCC that they are qualified for the position being offered.

How do I get an LMIA for Express Entry

There is a category of skilled professionally qualified foreign workers who can avail of the Express Entry. Labour Market Impact Assessment or LMIA needs to be completed in order to be granted an Express Entry.

It must be completed by a Canadian employer, who determines that a foreign worker is desirable because there is no Canadian worker available to fulfill the specific role.
